Entry Clearance Appeal - Spouse Visa

Facts: SU is a British citizen who is married to a Pakistani national. He sponsored his wife to join him on a spouse visa but the entry clearance application was refused by the entry clearance officer. The only reason given was that the ECO was not satisfied with the subsistence of the marriage. The Visa officer also refused to accept the birth certificate of the child born in the year 2012 as her birth certificate was issued in 2018.

Advice: We lodged appeals against both decisions and advised SU to gather further documentary evidences of subsistence of relationship, prepared the bundle for hearing, prepared SU for the hearing and engaged one of the best immigration barrister for the appeal hearing.

Outcome: The Immigration Judge allowed the appeal and the appellants were granted entry clearance within 3 months from Islamabad.
