    This is a sub-category of Temporary Workers and is for the non-EEA nationals to undertake unpaid voluntary work in line with the aims of his / her sponsor in the UK. Charity organizations can sponsor overseas nationals to carry out fieldwork directly related to the purpose of the organization.

    ATTRIBUTES FOR TIER 5 CHARITY WORKER VISA APPLICATION– CERTIFICATE OF SPONSORSHIP

    The sponsor i.e. charitable establishment will need to issue a sponsorship certificate to an individual to enable him to make his entry clearance application, which will give him 30 points under the point-based system.

    Further, the Sponsor must guarantee that he meets the following:

    • That the migrant intends to carry out voluntary fieldwork which is related to the objective(s) of the charity
    • That the migrant will not be paid for their work (this does not include such expenses that have been specified in section 44 of the National Minimum Wage Act;
    • That the migrant will be taking up a permanent role; and
    • That the migrant will be in compliance with the conditions leave, especially at its expiration.

    MAINTENANCE REQUIREMENTS FOR TIER 5 CHARITY WORKER VISA

    The applicant will require providing evidence of having at least £945 for at least 90 days at all times, which will give him 10 points under this section. The applicant will be able to invite/sponsor his / her dependents provided he can provide evidence of their maintenance at the rate of £630 for each dependent.

    Validity of Tier 5 Charity Workers Visa

    The maximum length of leave granted under this category is up to 12 months or the time given on your certificate of sponsorship plus 28 days, whichever is shorter.

    Please note this cannot be extended for any further period of time. Switching is not permitted as entry clearance is mandatory.

    REFUSAL OF ENTRY CLEARANCE OR REFUSAL OF LEAVE TO REMAIN – TIER 5 CHARITY WORKER VISA

    If the entry clearance application is refused by the ECO (visa officer) in the overseas British Diplomatic post or from in-country, the applicant will be given a right of review of the decision that must be exercised within 28 days of the date of service of the decision, in case of refusal of entry clearance or within 14 days from the date of service of the decision in case of refusal of leave to remain. There will not be any general right of appeal against any such decision made by the visa officer. If the administrative review also fails, the matter then can be taken to the Upper Tribunal by lodging judicial review proceedings.
